Terms and Conditions for InnerUs Foundationz Mental Health Services

These Terms and Conditions govern the use of the services provided by InnerUs Foundationz ("the Company," "we," "us," or "our"), including counseling, therapy, psychometric testing, and related services offered by therapists, doctors, and counselors through our website ("the Site"). By accessing or using the services, you ("the client," "user," or "patient") agree to comply with and be bound by these terms. If you do not agree with these terms, please do not use the Site or services.
1. Introduction and Acceptance of Terms
InnerUs Foundationz is a mental health services provider, offering both online and offline counseling, therapy, and psychometric services. By using our Site, services, or contacting us for appointments, you agree to the terms outlined in this document.
These terms are legally binding and subject to revision at any time. Continued use of the services after changes are posted constitutes acceptance of the revised terms.
2. Scope of Services

The services are provided by licensed and certified professionals, including therapists, doctors, and counselors, who operate under applicable legal and ethical guidelines.
3. Privacy and Confidentiality

We are committed to safeguarding the confidentiality of your personal and medical information in compliance with applicable privacy laws, including the Indian Information Technology Act (2000) and any subsequent amendments (IT Act), as well as guidelines from the Mental Healthcare Act of India.

- There is a breach of our terms by therapists, counselors, or doctors.

5. Responsibilities of Therapists, Doctors, and Counselors
All mental health professionals employed or contracted by InnerUs Foundationz are expected to uphold the highest standards of care. They are obligated to:

Any personal involvement between a client and a therapist, doctor, or counselor beyond the scope of professional services is strictly prohibited and will result in immediate termination of the involved professional. InnerUs Foundationz will not be held responsible for any issues arising from such personal involvement, and the company will not be harmed legally or verbally due to these personal relationships.
Breach of patient privacy, ethical misconduct, or inappropriate relationships will result in the termination of the professional involved, and they may be subject to legal action by InnerUs Foundationz and/or the affected client.
6. Client Responsibilities
Clients are responsible for providing accurate, complete information about their mental health conditions, symptoms, and history. You agree not to use the services for any unlawful or inappropriate activities. Misuse of the services, including false claims or providing inaccurate medical information, may result in termination of services and potential legal action.
7. Legal Actions for Breach
In the case of a breach of confidentiality or violation of these terms, the following legal actions may be taken:
- By the Company: InnerUs Foundationz reserves the right to pursue legal action against any therapist, doctor, or counselor found guilty of breaching confidentiality, patient trust, or engaging in illegal or unethical practices. This includes reporting to relevant legal and professional authorities.
- By the Client: Clients who believe that their privacy has been violated or their information misused may pursue legal remedies against InnerUs Foundationz or the responsible party. InnerUs Foundationz will cooperate fully with legal investigations while maintaining transparency with the affected client.

9. Termination of Services

- A client provides false information or engages in inappropriate behavior.

All content, including but not limited to written materials, logos, trademarks, designs, and graphics, displayed on the InnerUs Foundationz website are the property of the Company. These Terms and Conditions ("Agreement") govern the relationship between therapists, counselors, and mental health professionals ("Therapist" or "You") and InnerUs Foundationz ("the Company," "we," "us," or "our") with respect to the provision of mental health services through our website ("the Site") and related platforms. By entering into this Agreement, you agree to comply with the following terms and conditions. Failure to abide by these terms may result in immediate termination of your contract and legal action where necessary.

1. Introduction and Acceptance of Terms
InnerUs Foundationz provides mental health services both online and offline, with therapists, doctors, and counselors delivering services under this Agreement. By accepting this Agreement, you agree to adhere to all the terms, policies, and procedures outlined herein, as well as any future amendments or modifications.
Therapists must also comply with all applicable legal, ethical, and regulatory standards governing the practice of mental health professionals in India, including but not limited to the Mental Healthcare Act of India (2017) and other relevant laws.
2. Eligibility and Certification
To provide services for InnerUs Foundationz, you must:
- Hold valid and current licensure or certification from recognized regulatory bodies as required by Indian law.
- Provide accurate and up-to-date documentation to verify your credentials.
- Remain compliant with continuing education requirements and other regulatory standards.
Failure to maintain proper certification or licensure may result in immediate termination of your contract with the Company.
3. Professional Conduct and Ethical Standards
Therapists are expected to maintain the highest ethical standards while performing their duties. This includes:
- Maintaining professional boundaries with clients at all times.
- Delivering services in a manner that respects the client’s dignity, autonomy, and confidentiality.
- Avoiding conflicts of interest and not engaging in any form of dual relationships or personal involvement with clients.
Any personal involvement with a client outside of the professional services provided will result in immediate termination of your contract, and InnerUs Foundationz will not be held liable for any resulting damages or legal issues.
4. Confidentiality and Data Privacy
As a therapist at InnerUs Foundationz, you will have access to confidential and sensitive client information, including personal, psychological, and health data. You agree to:
- Strictly adhere to confidentiality standards as outlined in the Mental Healthcare Act of India and other applicable privacy regulations.
- Use client information solely for therapeutic purposes, and not collect, store, or transmit any client data outside of the Company’s secure systems.
Therapists are strictly prohibited from independently collecting or storing any client data for personal or external use. All client information must remain within the systems and databases managed by InnerUs Foundationz. Any violation of this policy will result in immediate termination and legal action.
5. Non-Compete and Non-Solicitation
During your engagement with InnerUs Foundationz and for a period of [Insert Duration] following the termination of your contract, you agree to the following:
- Non-Compete: You shall not, directly or indirectly, provide mental health services that compete with InnerUs Foundationz within the geographic areas or markets served by the Company.
- Non-Solicitation: You shall not solicit, hire, or attempt to engage any clients, employees, or business contacts of InnerUs Foundationz for personal business or competing ventures, either during or after your engagement with the Company.
Breaching these provisions will result in legal action for damages and potential injunctive relief.
6. Engagement in Other Practices
Therapists must inform InnerUs Foundationz in writing if they are involved in or plan to engage in any other mental health practices or professional activities outside the scope of their work with InnerUs Foundationz.
Failure to disclose other engagements will be considered a breach of contract, and InnerUs Foundationz reserves the right to terminate the contract immediately and pursue legal action if necessary. Engaging in outside practices that pose a conflict of interest or harm the reputation of InnerUs Foundationz will not be tolerated.
7. Intellectual Property Rights
All intellectual property, including but not limited to training materials, content, reports, and data, generated through your work with InnerUs Foundationz remains the exclusive property of the Company. Unauthorized use, reproduction, or distribution of such content is strictly prohibited.
Therapists may not claim ownership or intellectual property rights over any material provided or developed during their engagement with InnerUs Foundationz unless explicitly agreed upon in writing.
8. Termination of Contract
This Agreement may be terminated by either party for any of the following reasons:
- For Cause: InnerUs Foundationz reserves the right to terminate the contract immediately if a therapist breaches any of the terms outlined in this Agreement, engages in unethical or illegal conduct, or fails to maintain licensure and certifications.
- For Convenience: Either party may terminate this Agreement by providing [Insert Notice Period] written notice to the other party.
Upon termination, the therapist must immediately cease providing services and return all Company property, including confidential client records and any materials related to InnerUs Foundationz.
9. Liability and Indemnity
InnerUs Foundationz strives to provide quality mental health services and assumes no responsibility for any harm caused by the therapist’s actions outside the scope of their employment. You agree to:
- Indemnify and hold harmless InnerUs Foundationz, its officers, directors, employees, and agents from any claims, liabilities, damages, or losses arising from your negligent or unethical actions.
The Company shall not be liable for any direct or indirect damages, losses, or legal actions arising from personal involvement with clients or any actions that are in breach of professional conduct standards.
10. Dispute Resolution
In the event of any dispute arising from this Agreement, both parties agree to resolve the matter through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration will be Patiala, and the proceedings will be conducted in English.
11. Governing Law
This Agreement is governed by and construed in accordance with the laws of India. Any legal action arising from this Agreement will be subject to the exclusive jurisdiction of the courts of Patiala.
12. Entire Agreement
This Agreement constitutes the entire understanding between you and InnerUs Foundationz concerning the subject matter hereof and supersedes all prior agreements, whether written or oral. Any amendments to this Agreement must be made in writing and signed by both parties.
13. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
